# Terms and Conditions for SPIDEY 🕷️

## Agreement to Terms

By inviting SPIDEY ("the Bot") to your Discord server or using any of its features, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Bot.

## 1. Definitions

**"SPIDEY"** or **"the Bot"** refers to the Discord bot application and its services.

**"We," "Us," "Our"** refers to the developers and operators of SPIDEY.

**"You," "Your"** refers to the Discord server owner, administrator, or user accessing the Bot.

**"Server"** refers to a Discord guild/server where the Bot is invited.

**"User"** refers to any Discord user interacting with the Bot.

**"Tracked Member"** refers to users with roles designated for activity tracking.

**"Admin"** refers to server owners and users with administrator permissions.

## 2. Use License

### 2.1 Grant of License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use SPIDEY in your Discord server.

### 2.2 License Restrictions

You may NOT:
- ❌ Reverse engineer, decompile, or disassemble the Bot
- ❌ Attempt to gain unauthorized access to the Bot's systems
- ❌ Use the Bot for illegal activities
- ❌ Exploit bugs or vulnerabilities for malicious purposes
- ❌ Use the Bot to violate Discord's Terms of Service
- ❌ Resell, redistribute, or sublicense the Bot
- ❌ Remove or modify any copyright notices or branding
- ❌ Use the Bot to harass, abuse, or harm others

## 3. User Responsibilities

### 3.1 Server Administrator Responsibilities

As a server administrator using SPIDEY, you agree to:

**Configuration:**
- Properly configure the Bot using `/setup` command
- Assign appropriate roles and channels
- Ensure tracking complies with your server rules
- Inform server members about activity tracking

**Compliance:**
- Comply with Discord's Terms of Service and Community Guidelines
- Comply with local data protection laws (GDPR, CCPA, etc.)
- Obtain necessary consent from tracked members
- Respect user privacy and data protection rights

**Data Management:**
- Regularly review tracked data with `/config`
- Delete data when no longer needed using `/remove_config`
- Handle data deletion requests from server members
- Notify members of data collection practices

### 3.2 User Responsibilities

As a user interacting with SPIDEY, you agree to:

**Acceptable Use:**
- Use commands appropriately and not spam
- Not attempt to manipulate or game the tracking system
- Report bugs or issues to the support server
- Respect other users' privacy and data

**Account Security:**
- Keep your Discord account secure
- Do not share account access with others
- Report unauthorized access immediately

## 4. Bot Features and Functionality

### 4.1 Provided Services

SPIDEY provides the following services:

**Activity Tracking:**
- Message count tracking
- Voice channel time tracking
- All-time and monthly statistics
- Activity score calculations

**Leaderboards:**
- Real-time leaderboard updates
- Top 10 rankings display
- Separate staff and all-members tracking
- Beautiful embed presentations

**Commands:**
- `/setup` - Server configuration
- `/stats` - View statistics
- `/config` - Check settings
- `/remove_config` - Delete data
- `/scan` - Historical message analysis
- `/help_staff` - Command reference

### 4.2 Service Availability

**Uptime:**
- We strive for maximum uptime but do not guarantee 100% availability
- Maintenance may be performed with or without notice
- Service interruptions may occur due to technical issues

**No Warranty:**
- The Bot is provided "AS IS" without warranties of any kind
- We do not guarantee error-free operation
- We are not responsible for data loss due to technical failures

## 5. Data Collection and Privacy

### 5.1 Data Collection

By using SPIDEY, you acknowledge and consent to:

**Collected Data:**
- Server IDs, names, and configuration
- User IDs, usernames, and display names
- Message counts (not content)
- Voice channel participation time
- Activity timestamps

**Not Collected:**
- Message content or text
- Direct messages
- Personal information beyond Discord data
- Data from users without tracked roles

### 5.2 Privacy Policy

Full details are in our separate Privacy Policy. By using SPIDEY, you also agree to the Privacy Policy.

### 5.3 Data Storage

- Data is stored in SQLite database
- Each server's data is completely isolated
- Data is not shared with third parties
- Data can be deleted with `/remove_config`

## 6. Intellectual Property

### 6.1 Ownership

**Bot Ownership:**
- SPIDEY and all related code, designs, and features are owned by us
- All intellectual property rights are reserved
- The SPIDEY name and branding are our property

**User Content:**
- You retain ownership of your Discord server content
- We do not claim ownership of your server data
- Activity statistics derived from your server remain your data

### 6.2 Trademarks

- "SPIDEY 🕷️" is our trademark
- Spider-Man and related trademarks belong to Marvel/Disney
- We use spider imagery for thematic purposes only

## 7. Prohibited Activities

You may NOT use SPIDEY to:

**Illegal Activities:**
- ❌ Violate any laws or regulations
- ❌ Infringe on intellectual property rights
- ❌ Engage in fraud or deceptive practices

**Harmful Activities:**
- ❌ Harass, abuse, or threaten others
- ❌ Spread malware or viruses
- ❌ Collect user data for unauthorized purposes
- ❌ Spam or flood commands

**Discord Violations:**
- ❌ Violate Discord's Terms of Service
- ❌ Violate Discord's Community Guidelines
- ❌ Bypass Discord's rate limits or restrictions
- ❌ Use the Bot in servers that violate Discord's policies

**System Abuse:**
- ❌ Attempt to crash or overload the Bot
- ❌ Exploit bugs for personal gain
- ❌ Reverse engineer the Bot
- ❌ Create unauthorized clones or copies

## 8. Limitation of Liability

### 8.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

**Indirect Damages:**
- Loss of data, profits, or revenue
- Loss of server reputation or goodwill
- Service interruptions or downtime
- Inaccurate statistics or tracking errors

**Direct Damages:**
- Data corruption or loss
- Bot malfunction or bugs
- Incompatibility with other bots
- Configuration errors by administrators

### 8.2 Maximum Liability

Our total liability to you for any claims arising from these Terms or use of SPIDEY shall not exceed the amount you paid for the Bot (which is $0, as the Bot is free).

### 8.3 No Guarantees

We do not guarantee:
- Specific accuracy of tracking
- Compatibility with all Discord features
- Future availability of any features
- Support response times

## 9. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

- Your use or misuse of SPIDEY
- Your violation of these Terms
- Your violation of Discord's Terms of Service
- Your violation of applicable laws
- Data protection violations in your server
- Claims by your server members regarding tracking

## 10. Termination

### 10.1 Termination by You

You may stop using SPIDEY at any time by:
- Removing the Bot from your server
- Using `/remove_config` to delete all data
- No further obligations after removal

### 10.2 Termination by Us

We reserve the right to:
- Terminate or suspend your access without notice
- Remove the Bot from your server for Terms violations
- Discontinue the Bot service entirely
- Refuse service to any user or server

**Grounds for Termination:**
- Violation of these Terms
- Violation of Discord's Terms of Service
- Illegal activities using the Bot
- Abuse, harassment, or harmful behavior
- Attempts to exploit or damage the Bot

### 10.3 Effect of Termination

Upon termination:
- Your license to use the Bot ends immediately
- Data may be retained or deleted at our discretion
- You must cease all use of the Bot
- These Terms remain in effect for past use

## 11. Changes to Terms

### 11.1 Modification Rights

We reserve the right to modify these Terms at any time:
- Changes will be effective immediately upon posting
- "Last Updated" date will be modified
- Continued use constitutes acceptance of new Terms
- Material changes will be announced in support server

### 11.2 Notification

Major changes will be communicated via:
- Support server announcements
- Bot status updates
- Documentation updates
